This is the Terms and Conditions of Sale of the business trading as Langoustine the box. References to "we", "us" or "our" are references to Langoustine the box and its owner. We are a sole trader business based in Scotland, our VAT number is 234344427 and our place of trading is The Bowhouse, St-Monans, Fife, KY10 2DB. The website langoustinethebox.co.uk is owned and operated by Langoustine the box who uses it as an e-commerce platform to display information on goods to sell, agree sale contracts with consumers and collect payments.
We cannot promise that the website services will be available all of the time, meet your requirements or be fault free. Please, contact us by email to report any fault.
Your access to the website may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will restore the service as soon as we reasonably can.
Your use of the website does not mean that you are given any kind of intellectual property rights on its content including logos, trade marks (Langoustine the box and its logo are a trade mark registered at the Intellectual Property Office under No. UK00003173444), texts, graphics, photographs and images, videos or sounds. We make every effort to obtain appropriate licenses of use for the content displayed on our website. However, should you be the owner of intellectual property rights for a content displayed on langoustinethebox.co.uk and wanting to exercise your rights, please contact us by email.
The goods offered by Langoustine the box are displayed on the relevant webpage on langoustinethebox.co.uk. Due to the nature of our business, their availability can vary according to weather and seasonality (please check the How it works page to learn more about this). However we will make every effort to keep you informed: we recommend that you check the homepage on langoustinethebox.co.uk for the latest news on product availability.
Unless stated otherwise on the website, shellfish are sold whole, unprocessed and live. They are sold by weight or by number, depending on species. Additional information is provided regarding sizes and weight range.
Fresh shellfish in your order has been landed within 24 hours prior to being delivered to you. Your order is packed in the morning of your delivery day. We use polypropylene boxes that are insulated and pack the shellfish with ice to keep it fresh until you open your box. We may need more than one box to pack your order.
Please refer to the instructions on the box or check the FAQ page on the website to know how to deal with the goods you purchased once you have received your box(es).
The price of goods offered by Langoustine the box are set out on the relevant webpage on langoustinethebox.co.uk (Order shellfish page). We will make every effort to display the correct prices on our website however, due to the nature of our business, prices can vary according to weather and seasonality and we reserve the right to make any changes in the prices displayed with or without prior notice to you. Hence we recommend that you check the prices of our products on this website before placing an order.
Shellfish prices displayed are per 100 grammes or per piece, depending on species and vary according to sizes and weight ranges.
The total cost displayed on the My box page is inclusive of packaging charges but exclusive of delivery and value added tax (VAT).
The total cost of your order, displayed on the Checkout page, includes carriage charges and is inclusive of value added tax (VAT).
Placing your order before Tuesday 12:00pm allows you to choose a delivery day within the week whereas ordering after this time postpones the delivery day to the following week. We are sorry but we are not able to take orders to be delivered more than 1 week after being placed. Please check the How it works page on the website to learn why this is. However, if you are planning a substantial order, you are very welcomed to contact us more than 1 week in advance to discuss this with us.
To place an order you first need to create an account, where you will register your personal details, email address, invoice and delivery address (please check our Privacy Notice for more insight on what we do with your information). Then you use your username (the email address you supplied us with) and a password to log into your account, manage your details, place orders and use discounts.
By browsing our range of goods on the appropriate page on langoustinethebox.co.uk (Order shellfish page) you choose the products you want to buy by adding them to your online shopping basket (called My box). Products not available for order will appear shaded and you will not be able to select them. During the year we will be shut down for several periods of time for holidays: this will be notified via our mailing list, on the News page and the homepage (under Available next week) and all products will be set as unavailable, preventing you to place them in your basket.
Once you have filled your basket you can apply a discount code (if you have received one) and proceed to checkout. You need to be logged into your account to proceed to checkout.
When you are logged into you account, you can also consult your last orders and check their status. However we are sorry we cannot offer you the possibility to amend online an order you have placed. For any concerns regarding your pending order or delivery, please contact us by email (see the Contact page).
On the Choose a delivery mode page you will be asked to choose whether to be delivered or to come and pick-up your order at our premises in St. Monans. Fees apply and are displayed at this step of the process. Please refer to the FAQ page to know more about our delivery zone and the delivery fees. When your are filling your details in your account, you can choose whatever postcode you want for your billing address but you only have access to a limited numbers of postcodes (those which are in the delivery zone) for your delivery address.
Should adverse weather conditions arise, that impede either the catch of your order by the fishermen or its delivery to you by us, we will make every effort to notify you of this and let you choose between cancelling your order, and getting refunded, or postponing it until the following delivery day.
PAYMENT AND INVOICING
Once you click on the button at the bottom of the Checkout page, you recognize you have an obligation to pay. Your invoice is sent to you by email (and displayed in your account on the website) once payment has been collected. The payment of your order is due at the latest on the date of the delivery, however this varies according to the payment method you choose (before the Checkout page you will be asked to choose one of the 3 payment methods we offer):
- online card payment: the delay for your payment to be taken varies according to your card scheme (typically 1 to 3 days); a confirmation email is sent to you with your invoice just after you have paid
- electronic bank transfer: we would be very grateful if you would set up the transfer as soon as possible once you have placed your order and no later as the end of the week, to avoid having your order cancelled; a confirmation email is sent to you just after you have placed your order, with our bank details; your invoice is sent once the payment has arrived on our bank account
- cash payment (this payment method is available only up to a certain amount): your payment is collected on the day of delivery; a confirmation email is sent to you just after you have placed your order; your invoice is sent once we have collected your payment
You can cancel an order if you contact us by email, with the references of your order, before the end of the week during which you have placed it. We cannot accept cancellations after this date. If you have already paid, please provide your bank details in order for us to refund you. Our products, being fresh raw shellfish, are perishable. Therefore, once despatched, you cannot exercise the cancellation right that comes with other distance sales contracts.
CHANGES TO TERMS AND CONDITIONS
We reserve the right, with or without notice to you, to change these Terms and Conditions at our sole discretion. The Terms and Conditions applicable to your access to and use of this website will be the version that is displayed on the website at each date you access the website.
